1. Scope

These Terms and Conditions govern all agreements between the provider and the customer regarding the purchase of digital content (online courses) offered through the COLORALE Masterclass.

By completing the purchase, the customer confirms that they have read and accepted these Terms and Conditions.

3. Subject of the Contract

The subject of this agreement is the purchase of a digital online course (video content and accompanying materials).

No physical goods will be delivered.


4. Prices and Payment

All prices are stated in Swiss Francs (CHF).

Payment is processed via:

  • Credit card (Visa, etc.)
  • Other credit card providers
  • TWINT

Access to the course is granted only after successful payment.


5. Access and Use

After successful payment, the customer receives access to the online course via their user account (“My Account”).

Access is generally granted for an unlimited period, provided no violation of these Terms occurs.

The customer is responsible for keeping their login credentials confidential and must not share them with third parties.


6. Copyright and License

All content (videos, recipes, methods, techniques, documents, concepts, designs) is protected by copyright.

Upon purchase, the customer receives a:

  • non-exclusive
  • non-transferable
  • non-sublicensable

license for personal use only.


7. Prohibition of Sharing and Commercial Use

Any reproduction, distribution, sharing, or making available of the content—whether in whole or in part—is strictly prohibited.

In particular, it is forbidden to:

  • share content with third parties
  • share login credentials
  • distribute or publish content

It is also strictly prohibited to sell, offer, or commercially use any products or services that are based wholly or partially on the recipes, methods, or techniques taught in the course.

This applies regardless of whether the content has been modified or adapted.


8. Business License

Commercial use is only permitted with a separate Business License.

This:

  • is not included in the standard purchase
  • must be requested separately via email
  • becomes valid only upon written agreement

Without a valid Business License, any commercial use is prohibited.


9. Exclusion of Certain Persons

Persons who are directly or indirectly connected to the provider’s former gastronomy business are excluded from purchasing and using the course.

This includes, in particular:

  • current or former owners
  • employees
  • family members
  • business partners or associated persons

By purchasing, the customer explicitly confirms that no such connection exists.

In the event of a violation of these Terms, particularly:


10. Contractual Penalty and Account Suspension

  • unauthorized sharing of content
  • commercial use without a license
  • selling products based on the course content

a contractual penalty of at least CHF 5,000 per violation shall apply.

Each violation is treated as a separate case.

The provider reserves the right to:

  • immediately suspend access without prior notice
  • initiate legal action
  • claim additional damages

The contractual penalty shall be owed for each individual violation, including, in particular, for each unauthorized sharing, each use by third parties, and each product sold.

The contractual penalty shall apply to each individual violation. Each unauthorized disclosure, each instance of access or use by a third party, and each product or service sold or offered based on the course content shall constitute a separate violation.

The contractual penalty is owed irrespective of actual damages. The right to claim further damages remains expressly reserved.


11. No Refund Policy

As this is a digital product with immediate access upon purchase, no refunds are granted.

The customer assumes full responsibility for how the content is applied.

For questions or support, the provider can be contacted via email. Responses are typically provided within 24 hours.


12. Liability

The course is provided for educational purposes only.

The provider makes no guarantees regarding:

  • specific results
  • business success
  • individual outcomes

Liability is excluded to the extent permitted by law, except in cases of intentional or grossly negligent conduct.


13. Data Protection

Personal data is processed in accordance with the separate Privacy Policy.


14. Amendments

The provider reserves the right to modify these Terms at any time. The version valid at the time of purchase shall apply.


15. Governing Law and Jurisdiction

Swiss law shall apply exclusively.

The place of jurisdiction is the registered office of the provider in Switzerland.

In case of discrepancies, the German version shall prevail
